Policies, Practices, and Expectations

These are the real-world terms that shape how I work with clients—clear, fair, and based on experience. They aren’t written by lawyers; they’re written by me, Dakota Hoskins, (with ai help) to keep our projects smooth, transparent, and mutually respectful.

1) Scope of Services

My work covers websites, automations, and AI systems under the One Up brand. Depending on your plan, this may include:

2) Fees and Payment

2.1 Subscriptions

Hosting and maintenance plans are billed monthly or annually and renew automatically unless canceled through the Client Portal.

2.2 Hourly & Project Work

Work outside your plan (new pages, integrations, strategy sessions, etc.) is billed hourly or under a quoted project rate. If you don’t have included hours and request help, that request is treated as consent to track and bill for time.

2.3 Late Payments

Unpaid invoices may result in paused services. Late fees or reinstatement charges may apply if payment is delayed beyond 10 days.

3) Ending a Service

3.1 If You Cancel

You can cancel any time through the Client Portal. Service remains active through your current billing period. No prorated refunds are issued.

3.2 If I Cancel

I reserve the right to end services with 14 days’ written notice—or immediately in cases of abuse, nonpayment, or policy violations.

Each plan includes a set amount of support time per month. Unused time doesn’t roll over. Response times depend on workload and request type. For urgent issues, text is best.

5) Additional or Emergency Work

If something breaks, I’ll prioritize fixing it. If a request is outside your plan or exceeds included time, I’ll provide an estimate whenever possible. In emergencies where pre-approval isn’t realistic, I’ll proceed with the necessary work and communicate costs as soon as possible.

6) Time Tokens

Time Tokens make tracking easier and fairer for everyone.

Anywhere tokens appear in the Client Portal, you’ll also see their hour equivalent—you don’t need to “speak in tokens” unless you want to.

7) Consulting, Planning, and Research

Some projects require deeper strategy—technical planning, documentation, or architecture. Not every email or meeting is billable, but extended consulting time is if a project becomes complex or requires detailed research.
You’ll always be informed before that happens. This keeps things fair for both quick-turn clients and those with larger builds.

8) Client Responsibilities

You’re responsible for:

Delays in approvals or content delivery can delay completion or halt work altogether. I’ll make it as easy as possible with forms and portal tools, but your participation is still essential to getting results.

9) Ownership, Access, and Professional Integrity

You own your stuff. Your website, domain, content, and data are yours — not mine. Anything you’ve paid for or provided (like copy, images, or brand assets) remains your property, even if I helped you set it up.
If you ever decide to move on:

The only exception applies to shared systems or licenses that depend on One Up’s infrastructure (like premium plugin licenses or AI services). Those stay with my platform and may stop working after your plan ends — but your data and content remain yours to take anywhere.

11) Software Licenses & APIs

Active subscribers get access to certain premium software through One Up’s shared licenses (examples below). Licenses remain valid only while your plan is active.

When a subscription ends, premium licenses are removed. Some tools may keep partial functionality; others may stop entirely. I may update or replace licensed software at any time if better tools become available.

12) AI Agents & Automated Systems

AI features are powerful—but experimental. I use them daily and refine them constantly, but results can vary.
By using One Up’s AI systems, you acknowledge and agree that:

I take security and reliability seriously, but no system is flawless. My liability for any claim is limited to the amount you’ve paid during the current billing period.

14) Revisions & Updates

These working terms evolve as my systems do. If something changes, I’ll note it here or in the Client Portal. Continued use of services means you accept the current version.

15) Governing Principles

These policies are built on respect, fairness, and transparency. I’ll do my part to deliver consistently high-quality work and communication; I expect the same professionalism in return. We’ll keep it simple, honest, and productive—so both sides win.

We do not knowingly collect personal data from children under 13.

We do not allow third parties to use your data for marketing their own products.


5) SMS Program privacy

  • When you opt in to receive text messages, we store your phone number, consent record, and message activity.

  • Text message content is logged for compliance and support purposes.

  • You can opt out anytime by texting STOP.

  • We don’t send marketing texts under this program.


6) Data retention

We retain information as long as necessary to provide Services, meet legal obligations, resolve disputes, and enforce agreements. Opt-out records (STOP requests) are retained to ensure compliance.


7) Your rights under California law (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what categories of personal information we collect and how we use it.

  • Request deletion of your personal information (subject to legal/contractual exceptions).
